Distance Selling Contract

1. Parties

 

This Distance Selling Contract (“Contract”) is concluded electronically between the following parties:

PLATFORM:
The platform service providers PAYNBUY TECHNOLOGY, ORPICH REKLAM TEKNOLOJI LTD and MEGATRON TECHNOLOGY LTD., hereinafter collectively referred to as the “PLATFORM”.

BUYER:
The real person or consumer purchasing digital products and/or services through the website epinpay.com, hereinafter referred to as the “BUYER”.

SELLER:
The registered member conducting the sale of digital products via the PLATFORM, hereinafter referred to as the “SELLER”.

 

2. Subject of the Contract

 

The purpose of this Contract is to regulate the rights and obligations of the parties regarding the purchase of digital products and/or services by the BUYER through the website epinpay.com, which is owned and operated by the PLATFORM, as well as the intermediation of such sales by the PLATFORM or the SELLER.

The PLATFORM may directly sell digital game codes, e-pins, and similar digital contents, or provide intermediary services between members in listing-based transactions in return for a commission.

In this context, the PLATFORM acts solely as an intermediary and assumes no direct responsibility regarding the content, quality, or legal status of the products or services offered by third-party SELLERS.

 

3. Products and Services Covered by the Contract

 

The products and/or services covered by this Contract are digital goods purchased by the BUYER through epinpay.com. These may include, but are not limited to, in-game currencies, digital codes, account credentials, and other intangible items.

 

4. Payment Terms

 

The BUYER shall make payments using the payment methods provided by the PLATFORM at the time of purchase. All payment amounts are collected by the PLATFORM.

In marketplace transactions, the PLATFORM deducts its commission fee and transfers the remaining balance to the respective SELLER. Commission rates are determined by the PLATFORM and are deemed to be accepted by the SELLER upon completion of the transaction.

 

5. Delivery and Right of Withdrawal / Refund Policy

 

Digital products purchased through the PLATFORM are delivered electronically via the system after the payment process is completed. Once delivered, the products become immediately accessible for the BUYER’s use.

Pursuant to Article 15, paragraph 1(g) of the Regulation on Distance Contracts enacted under Law No. 6502 on the Protection of Consumers: “The right of withdrawal shall not apply to contracts relating to services that are performed instantly in an electronic environment or to intangible goods that are instantly delivered to the consumer.”

Accordingly, refunds or cancellations are not possible for digital products purchased through epinpay.com. The BUYER acknowledges and expressly declares that, by completing the purchase, they accept that the digital product is delivered instantly and that the right of withdrawal shall not apply.

 

6. Privacy and Protection of Personal Data

 

All personal data belonging to the BUYER and the SELLER are processed in accordance with Law No. 6698 on the Protection of Personal Data (KVKK) and within the framework of the epinpay.com Privacy Policy and the KVKK Information Notice.

Personal data are used solely for the provision of services and the fulfillment of legal obligations. The PLATFORM takes all necessary technical and administrative measures to ensure data security and confidentiality.

 

7. Entry into Force

 

This Contract enters into force upon the electronic confirmation of this Contract by the BUYER on epinpay.com and the completion of the purchase transaction.

 

8. Governing Law and Dispute Resolution

 

In the event of any dispute arising from or in connection with this Contract, the Consumer Arbitration Committees and Consumer Courts located in the BUYER’s place of residence, within the monetary limits determined by the Ministry of Customs and Trade, shall have jurisdiction.
