EPINPAY TERMS AND CONDITIONS

Please read the following terms and conditions carefully before using our platform. By registering on or making a transaction through the Platform, you accept these terms and conditions. If you do not accept them, please do not use the Platform.

1. Parties and Introduction

1.1. The owner and operator of the Epinpay brand and the epinpay.com website (the “Platform”) is Orpich Reklam Teknoloji Limited Şirketi (MERSIS No: 0647080062000001, Tax ID: 6470800620, Trade Registry No: 265391, Address: Osmangazi Mah. 587 Sk. No: 22 Bayraklı / İzmir, Türkiye).

1.2. For sales made through the Platform, the company acting as seller, invoicing entity, and Merchant of Record is determined by the payment method selected at checkout: Orpich Reklam Teknoloji Limited Şirketi for payment methods contracted with Orpich, and Paynbuy Technology FZCO (United Arab Emirates, Registration No: 23483) for payment methods contracted with Paynbuy. The relevant company is stated during checkout and on the invoice, and is responsible for the sale, delivery, refunds, and chargebacks for that order. In this Agreement, the two companies are referred to jointly or individually as “Epinpay”.

1.3. These Terms and Conditions (the “Agreement”) govern the use of all services offered through the Platform. For purchases, the Distance Selling Contract and pre-contractual information also apply.

2. Definitions

• Platform: epinpay.com and related digital services.
• User / Buyer: A person who registers on the Platform or purchases products through the Platform.
• Product: Intangible goods such as digital game codes, e-pins, gift cards, and in-game currency top-ups.
• Supplier: A commercial partner under contract with Epinpay from which Epinpay sources products. Suppliers are not sellers on the Platform and do not enter into contracts directly with users.
• Balance: The account balance a user can use for purchases on the Platform.
• KVKK: Turkish Personal Data Protection Law No. 6698.

3. Membership

3.1. Only persons aged 18 or over with full legal capacity may become members of the Platform.

3.2. Users must provide accurate, current, and complete information during registration. Epinpay may suspend accounts in case of false information.

3.3. Each user may open only one account. If fake or duplicate accounts are detected, the related transactions may be cancelled and the account closed.

3.4. Users are responsible for the password and security of their accounts. Epinpay is not liable for damages resulting from unauthorized access caused by the user's fault.

3.5. Membership does not entitle users to sell products, open stores, or publish listings on the Platform.

4. General Terms of Use

4.1. The Platform may only be used for lawful and honest purposes.

4.2. The Platform may not be used for fraud, the use of stolen payment instruments, deceptive transactions, or money laundering.

4.3. Users may not use automated systems, bots, or similar tools that could compromise the security or operation of the Platform.

5. Products and Suppliers

5.1. All products sold on the Platform are sourced from Epinpay's contracted suppliers and sold to users by the selling company specified in Section 1.2.

5.2. For transparency, the name and offer details of the supplier from which a product is sourced may be displayed for some products. This does not change the user's contractual counterparty, which is always the relevant Epinpay company.

5.3. Product descriptions, prices, and region and platform information are published by Epinpay. Epinpay is responsible to the user for incorrect or incomplete deliveries caused by a supplier.

5.4. Epinpay may change product and price information without prior notice and remove out-of-stock products from sale. For confirmed orders, the price at the time of the order applies.

6. Orders and Payment

6.1. Before purchasing, the user is responsible for checking the product description, game region, and activation conditions.

6.2. Payments are collected through the payment methods offered on the Platform and via licensed payment service providers.

6.3. Epinpay may subject orders to additional verification, delay them, or decline them for fraud prevention purposes or legal obligations. The amount of declined orders is refunded.

7. Delivery and Returns

7.1. Digital products are delivered automatically or manually after the payment is confirmed.

7.2. Pursuant to Article 15(1)(ğ) of the Turkish Regulation on Distance Contracts, the right of withdrawal cannot be exercised after delivery for intangible goods delivered instantly by electronic means.

7.3. For defective, incomplete, invalid, or undelivered products, the user may exercise the rights arising from Turkish Consumer Protection Law No. 6502 and other applicable consumer laws. For justified requests, the product is replaced or the amount refunded, at the user's choice, to the payment method or to the Epinpay balance.

8. Buyer Protection

8.1. Epinpay undertakes that purchased products will be delivered as described on the product page.

8.2. If a delivered product is invalid, incorrect, or incomplete, the user may contact the support team; following review, the product is replaced or the amount refunded.

9. Balance, EP Points, and Promotions

9.1. Balance, EP points, bonuses, and promotional credits may only be used under the conditions announced on the Platform.

9.2. Participation in streamer and similar affiliate programs is subject to separate program-specific terms.

10. Prohibited Use

10.1. Users are responsible for using products in a way that complies with game publishers' terms of use.

10.2. In case of unjustified chargebacks, false refund claims, or misuse of the Platform, Epinpay may restrict the account and take legal action.

11. Privacy and Personal Data

11.1. Personal data is processed in accordance with the KVKK, the GDPR where applicable, and other relevant legislation.

11.2. Details are set out in the Privacy Policy, the KVKK Information Notice, and the Cookie Policy.

12. Account Suspension and Closure

12.1. Epinpay may suspend or close an account due to a breach of this Agreement, suspected fraud, or legal obligations.

12.2. Upon account closure, any balance due to the user is refunded, subject to review and blocking obligations under applicable law and any amounts owed by the user to Epinpay.

13. Governing Law and Dispute Resolution

13.1. Users should first contact the support team.

13.2. For consumers residing in Türkiye, Turkish law applies; Consumer Arbitration Boards have jurisdiction within the monetary limits set by the Ministry of Trade, and Consumer Courts have jurisdiction above these limits.

13.3. For consumers in other countries, the law applicable to the relevant selling company applies, without prejudice to the mandatory consumer protection rules of the consumer's country of residence.

13.4. For disputes between Orpich and users who are not consumers, Turkish law applies and the İzmir Courts and Enforcement Offices have jurisdiction.

14. Intellectual Property

14.1. Content, trademarks, and logos on the Platform belong to Orpich Reklam Teknoloji Limited Şirketi or the respective right holders. Game names and trademarks belong to their respective publishers.

14.2. Content may not be copied, reproduced, or shared without permission.

15. Amendments

15.1. Epinpay may update this Agreement. The updated text enters into force on the date it is published on epinpay.com; material changes to the user's detriment are announced to users within a reasonable period before they take effect.

15.2. Changes do not apply to transactions completed before their effective date.
